California Civil Code 3342 delineates dog bite law, and states that the owner of a dog is liable to anyone bitten by the dog that is:

  • In a public place
  • Lawfully in a private place (including the dog owner's home)

This section of the civil code is important because it creates what is referred to as "strict liability."  Dog owners are liable for their animal's actions if it is their first time biting someone, or if they have bitten individuals multiple times.  Circumstances such as if the dog was on a leash or if it was on or off its owner's property are irrelevant.  In the case of an attack, the owner is almost always held responsible.
