California Dog Bite Law

Long Beach Dog Bite Lawyer

California Civil Code 3342 delineates dog bite law, and states that the owner of a dog is liable to anyone bitten by the dog that is:

  • In a public place
  • Lawfully in a private place (including the dog owner's home)

This section of the civil code is important because it creates what is referred to as "strict liability."  Dog owners are liable for their animal's actions if it is their first time biting someone, or if they have bitten individuals multiple times.  Circumstances such as if the dog was on a leash or if it was on or off its owner's property are irrelevant.  In the case of an attack, the owner is almost always held responsible.

It should be noted that this section refers only to dog owners, not caretakers.  If a dog bites someone while in the possession of a caretaker, then that individual will likely not be held liable for the dog's actions.  This does not mean they will entirely escape responsibility, but they do not have strict liability like dog owners do.  If you have been bitten by a dog and are seeking compensation for the injuries you have sustained, contact a Long Beach dog bite lawyer who can assist you by providing legal representation in your case.
